O Tribunal de Contas da União (TCU) multou na semana passada a ex-presidente do Instituto do Patrimônio Histórico e Artístico Nacional (Iphan), Kátia Bogéa, em 10 mil reais, assim como aplicou multa com o mesmo valor ao ex-diretor de Planejamento e Administração do Iphan, Marcos José Silva Rego, por violações da Lei de Licitações e da Lei do Processo Administrativo. A multa decorre do julgamento sobre irregularidades na locação, em 2016, do Edificio Centro Empresarial Cidade Nova (Teleporto), pertencente à Fundação Vale Rio Doce de Seguridade Social (Valia), para abrigar unidades do Ministério da Cultura sediadas no Palácio Gustavo Capanema (prédio tombado que até então abrigava essas entidades, e entraria em reforma). Kátia Bogéa foi presidente do Iphan entre 2016 e 2019, na gestão de Michel Temer.
O aluguel, de R$ 1,125 milhão em 2021, foi objeto de denúncia por causa do valor (mais de 50% do preço de mercado, segundo levantamento da FIPE), discrepância na metragem (com muita área ociosa gerando pagamento desnecessário de aluguel) e ausência do princípio de economicidade, o que, em dado momento do contrato, levou a um gasto adicional de mais de R$ 2 milhões com contratação de seguro contra incêndio e IPTU.
Conforme o TCU decidiu, a locação do edifício da Vale, pelo Iphan, foi cercada de falhas de planejamento, instrução e conformação jurídica, entra as quais o tribunal destacou as seguintes: a) insuficiência de pesquisa de preços e ausência de avaliação mercadológica prévia, em afronta direta à regra de licitações, que exige a compatibilidade do valor da locação com os parâmetros de mercado; b) dimensionamento deficiente da área, sem memória de cálculo que justificasse a metragem locada; c) inobservância injustificada de recomendações jurídicas, em afronta à lei, que exige o exame e a aprovação das minutas contratuais pela assessoria jurídica; d)inserção de cláusulas desproporcionais – com multas rescisórias equivalentes a dez meses de aluguel e encargos moratórios antieconômicos – que violaram os princípios da razoabilidade e da economicidade, previstos no art. 70 da Constituição Federal e no art. 2º da Lei 9.784/1999. “Tais dispositivos alocaram riscos de forma excessivamente gravosa à Administração (federal)”, anotou o tribunal. A Fundação Valia não foi penalizada.
Em sua defesa no TCU, Kátia Bogéa destacou que a locação do imóvel foi motivada por determinação do então Ministro da Cultura, Marcelo Calero, para que o Iphan providenciasse um espaço adequado para abrigar as unidades vinculadas ao MC e seus servidores, além dos acervos culturais e documentais sob responsabilidade dessas entidades. Diante da inexistência de imóvel público adequado, o Iphan terminou buscando alternativas no mercado privado, culminando na escolha do Centro Empresarial Cidade Nova (Teleporto), localizado no Centro do Rio, que foi considerado vantajoso por sua localização e fácil acesso.
O espaço locado totalizava uma área de 14.230 m², e um estudo de viabilidade foi elaborado pela consultora Clarice F. Mühlbauer, com base nas especificidades das unidades vinculadas e dos servidores. O projeto incluiu adaptações, como pontos de energia, divisórias, refeitório e distribuição espacial dos acervos. A ex-presidente refutou alegações de desperdício de recursos públicos, afirmando que a área locada era compatível com as necessidades informadas e que não houve comprovação de disponibilidade de imóvel público equivalente. Kátia reconheceu que houve busca por ajustes, após orientações da Procuradoria Federal do Iphan, mas argumenta que eventuais cláusulas abusivas não geraram pagamentos indevidos e poderiam ser afastadas judicialmente, caso necessário.
O contexto de urgência do aluguel do edifício, a negociação posterior de descontos contratuais, a carência inicialmente obtida e o fato de a exigência de estudos técnicos preliminares ter sido mais bem consolidada apenas posteriormente pela Istrução Normativa 5/2017 configuram circunstâncias atenuantes, na visão do TCU. “Todavia, não afastam a responsabilidade pelas impropriedades, que violaram os deveres de motivação, prudência administrativa e observância dos pareceres jurídicos, colocando o Iphan em posição de fragilidade na relação contratual”. A decisão do ministro relator Jhonatan de Jesus foi publicada essa semana no Diário Oficial da União. Os ex-gestores têm 15 dias para pagar a multa.
